BOOKING TERMS AND CONDITIONS
AGREEMENT TO BE BOUND
This Agreement defined our terms and conditions. By booking with Elevate Properties you’re agreeing to: (a) accept the terms and conditions of this agreement; (b) follow the rules and consequences described in this Agreement. This agreement is personal to you and may not be transferred or assigned to any other person(s).
RENTER REQUIREMENTS
For legal and accounting purposes, the person placing the reservation must be the same as the credit/debit card holder. This person is considered to be the guest. All other persons involved with the rental are considered to be the guest's invitees, and all discussions regarding reservation, cancelation and damage policies will be discussed with the guest, not the guest's invitees. The guest understands that Elevate Properties rents to responsible adults over the age of 21 only.
PAYMENT TERMS
The guest will be required to settle 100% of the total amount of the reservation to hold the dates.
For Long-Term Reservations: The guest will be required to settle 100% of the total amount of the reservation to hold the dates. If the guest decides to extend the reservation, the extension's balance is due 14 days prior to the start of the extension. If the request to extend is made within 14 days, 100% payment is required to hold the extension dates upon request.
Important Note: For third-party booking platforms such as Booking.com, VRBO, etc - please refer to their payment policy.
PROPERTY USE
The guest should abide by the property rules and the clause of the rental agreement. The property is for residential use only. The rental is not intended for parties, gatherings, or photo ops at any time. If there is excessive noise or music, any illegal activity, or evidence of a violation of these policies, you may be asked to vacate the premise without any refund and additional charges may be assessed. Please inform us of any change in the number of guests before your arrival to avoid these charges and so the cabin can be prepared appropriately for your group. No exceptions or refunds are given for changes in the number of guests after your arrival.
SECURITY DEPOSIT & DAMAGE TO PROPERTY
The security deposit only applies to non-Airbnb reservations. The guest is expected to leave the property in the same condition it was upon arrival. The guest will authorize a security deposit. The security deposit is released 7 days after the property is vacated and all terms and conditions of this agreement are satisfied. In the event of any breach, the security deposit shall be retained to compensate Elevate Properties which includes payment of the cost of extra cleaning, repairing, or replacing any of the property, its contents or common areas and recreational facilities, lost rental income, and expenses related to future guests. The guest is expected to leave the property in the same condition it was upon arrival. In the event that said deposit is insufficient for that purpose, the guest shall pay the additional costs on demand, and hereby authorizes Elevate Properties to charge such costs to the card on file.
DAMAGE WAIVER
The damage waiver only applies to non-Airbnb reservations. Our properties are inspected before and after each reservation. Guests agree to pay for any flagrant damage to the units, excessive cleaning required at check-out, missing or damage to the units’ contents or any other accidental damage to anything within the rental unit during the rental period. Your reservation includes a damage waiver of $59.99 to cover up to $1,500.00 or $79.99 to cover up to $3000 (whichever is present) in damage or we collected a deposit. If any damages are above this, then the guest authorizes any said damage or missing items charged to their credit card identified above.
As a condition to the rental of all vacation properties, Elevate Properties reserves the right to charge the guest’s credit card for any and all uncovered guest/invitee-caused losses and damages sustained to the vacation property throughout the duration of their period of occupancy. In the event of any uncovered guest/invitee-caused loss or damage to the Vacation Property, including, but not limited to, undue cleaning, eviction, service calls, service charges, fines/assessments, repairs or replacements, plus all applicable taxes, Elevate Properties is hereby granted the right to charge the guest's credit card. An itemized statement outlining all associated costs will be sent via regular or electronic mail to the address submitted by the guest at such time as the reservation was booked. By written or electronic endorsement of this Agreement, the guest hereby agrees to pay for all such charges, as defined above and on the proceeding pages.
CHECK-IN
Early check-in requests are subject to availability and can't be guaranteed. The guest can check a day prior to arrival if a potential early check-in can be granted. If we're able to accommodate an early check-in, an early fee will be required. Rates of the early check-in fee are subject to change.
Unauthorized early check-in is subject to a $30 fee per 30 minutes.
CHECK-OUT
The standard check-out time is on or before 11AM. Late check-out requests are subject to availability and can't be guaranteed. The guest can check a day prior to departure if a potential late check-out can be granted. If we're able to accommodate a late check-out, a late check-out fee will be required. Rates of the late check-out fee are subject to change.
Unauthorized late check-out is subject to a $30 fee per 30 minutes.
GUESTS
The guest must book the property with the correct number of persons. The guests are all expected to follow the rules at all times. Extra guests can be added prior to arrival within the maximum guest count allowable for the property booked.
Please be reminded that we will only prepare for the declared number of guests. Any unauthorized guests will be charged automatically toward your reservation.
PET POLICY
Please refer to the pet policy for each property as it differs. If you're unsure of the pet policy, please reach out to our support team.
For pet-friendly properties, there is a non-refundable pet fee of $100 per pet (pet weight limit, allowable pet count and pet conditions vary per property). The unauthorized bringing of pets will have a penalty of $300 which will go towards the deep cleaning of the property.
We do ask that pets stay off the furniture and that any pet waste is picked up, including outside. The pet fee (and pet penalty, if incurred) does not cover any damage, such as urine or scratch marks, and will be charged to the card on file.
SUPPLIES
A starter supply of expendable supplies such as paper goods and soap is provided; please bring additional if you feel this will not be adequate. Bath towels, sheets, pillows, and blankets are provided.
SMOKING
This is a 100% non-property. Smoking isn’t permitted on the property, including on balconies, and outdoor and common areas. Guests are subject to a $300 fine plus the cost to clean, deodorize, and repair damages.
RISK OF LOSS
The owner shall not be liable for any loss by reason of damage, theft, or otherwise to the contents, belongings, and personal effects of the guest, or guest’s family, day guests, or visitors. Guests must keep all doors, windows, gates, and balconies (if applicable) locked when leaving the property.
We shall not be liable for the left behind items during the stay. If the left behinds were found, we are willing to ship them to the registered guest upon request. Shipping charges will be charged to the guest plus a $30 service fee. Items unclaimed will be held for a maximum of 14 days at which time, Elevate Properties reserves the right to dispose of or may elect to discard or donate the item(s) to a local charity.
PROPERTY ACCESS
The guest agrees to allow access to the property to Elevate Properties and its contractors anytime with given notice by phone, SMS, email, or in person. Contractors include but are not limited to, plumbers, electricians, pest inspection, pool and/or hot tub maintenance, snow maintenance, etc. Elevate Properties reserves the right to inspect the property with prior notice to the guest. The guest agrees not to deny access. If the guest refuses to allow access to Elevate Properties or any contractors designated, Elevate Properties reserves the right to terminate the guest's vacation rental, and the guest will immediately vacate the premises upon demand by Elevate Properties and will forfeit the reservation payment.
REDECORATION OR ALTERATIONS
The guest shall not redecorate or make any alterations to the property, in any way, that would constitute the making of alterations, repaint the walls or woodwork, re-arrangement of furniture, etc without first obtaining Elevate Propeties' written consent to the alterations or redecoration.
PACKAGE DELIVERY
Guests aren't permitted to ship any packages, suitcases, or belongings to the property. Guest may ship packages to a nearby courier location (i.e. USPS, UPS, FedEx) and retrieve them.
CANCELLATION BY GUEST
The cancellation policy is applicable to guests who booked directly with Elevate Properties.
- If the guest decides to cancel 30 days or more prior to the check-in date, the guest is entitled to a 100% refund.
- If the guest decides to cancel between 30 days to 14 days prior to the check-in date, the guest is entitled to 50% of the total amount of the reservation.
- If the guest decides to cancel within 14 days prior to check-in, the payment is forfeited.
A reservation canceled 30 days from check-in can be rescheduled to a different date with at least 14 days' notice and might incur a price difference. The cancelation policy of the rescheduled date will not be reset and will be based on the original reservation's cancelation policy.
Important Note: For third-party booking platforms such as Airbnb, Booking.com, VRBO, etc, please refer to their cancellation policy.
EXTENUATING CIRCUMSTANCE
The extenuating circumstances policy only applies to non-Airbnb reservations. Elevate Properties will not be liable for events beyond their control that may interfere with the guest’s occupancy, including but not limited to Acts of God, acts of governmental agencies, fire, strikes, war, snow conditions, road conditions, power outages, or inclement weather. No refund will be offered in these circumstances.
We recommend getting travel insurance for such events. Cancellation due to death can be offered to reschedule only. Please be reminded that we will require supporting documents of your claim to validate the cancellation.
For Airbnb reservations, please refer to the extenuating circumstance policy by Airbnb.
AGREEMENT TERMINATION
The property reserves the right to terminate the rental agreement under the following circumstances:
- If the guest broke the property rules. No refund will be issued.
- If the police force is called upon the property due to several complaints.
- If the guest is subletting the property to another person. No refund will be issued.
- The property will undertake major repairs, renovation, or as directed by the local government.
CHARGE-BACK
By signing this rental agreement, you waive your right to issue a charge-back.
INDEMNIFICATION & HOLD HARMLESS
While Elevate Properties and its property owners strive to maintain vacation properties in the finest condition, no guarantees are expressed nor implied regarding suitability or for any particular purpose. All guest(s) and their invitees use the vacation property structures and premises at their own risk. Elevate Properties and its property owners shall not be held liable or otherwise responsible in any way for injury to any guest and/or their invitees that is caused or permitted to be caused by the intentional or unintentional acts of the said guest(s) and/or invitees, or by the failure of structures, appliances, (including hot tubs and BBQs) furnishings, and/or other equipment, whether by malfunction, misuse, acts of god/nature, and/or are otherwise naturally occurring. No guarantees are expressed nor implied as to the suitability of utilities and other services provided to the vacation properties and adjacent structures and premises. No guarantees are expressed nor implied regarding the suitability/compatibility of materials utilized in the construction of the vacation property and/or its contents. Elevate Properties and its property owners shall not be held liable nor otherwise responsible in any way for allergic reactions to guest(s) or invitees, caused or permitted to be caused by materials utilized in the manufacture of the vacation property and/or its contents, nor from mold and/or airborne spores, nor from pet/animal allergens, nor from chemical agents including, but not limited to appliances, linens, carpeting, utensils, fixtures, hot tubs, and/or other equipment. By written or electronic endorsement of this agreement, guest(s) and invitees hereby agree to forever hold harmless and indemnify Elevate Properties and its property owners from and against all claims, demands, loss, liability/responsibility of any kind and character, including the cost of defense, arising out of or in any way connected with the guest(s) use of the property.
By booking the property, you agree to all clauses and policies of Elevate Properties.
